The Chairman welcomed everyone to the hearing.

The Hearing gave consideration to the report of the Head of the Licensing Partnership, which detailed that a variation application had been received to have two conditions removed from the existing licence following the review hearing held on 8 March 2024.

Resolved: That, under section 100A(4) of the Local Government Act 1972, the public be excluded from the meeting on the grounds that likely disclosure of exempt information is involved as defined by Schedule 12A, paragraph 7 (Information relating to any action taken or to be taken in connection with the prevention, investigation or prosecution of crime.)

The Head of Licensing Partnership confirmed additional documentation had been received from the applicant’s agent the evening before the hearing and these had been circulated to the Sub-Committee.

The Panel heard from the owner and former licence holder, present licence holder together with their legal advisor, a representative of Kent Police, and asked questions of clarification, as contained within the confidential appendix to these minutes.

At 11:42 a.m., the Hearing Members withdrew to consider the issues raised, accompanied by the Council’s Legal Advisor and Clerk to the Hearing for the purpose of providing advice only.

At 12:44 p.m., the Hearing Members, the Council’s Legal Advisor, and the Clerk returned to the Conference Room.

The Chairman moved that having had regard to the representations made by the Applicant and interested parties, the Licensing objectives, the Statutory Guidance issued under Section 182 of the Act, and the Council’s Statement of Licensing Policy the Sub-Committee intended to remove the second additional condition but retain the first condition. Further reasons were set out within the confidential appendix and the Hearing was advised  that a full decision notice would be made available to parties within 5 working days of the Hearing.
