The Hearing gave consideration to a report by the Chief Officer Environmental and Operational Services giving details of an application for a new premises licence under the Licensing Act 2003. It was noted that objections had been received and that accordingly the application had been referred to the Sub-Committee for determination. 

 

The Hearing heard from the applicant’s representative.

 

In response to questions the applicant’s representative responded that he had 20 years experience of running convenience stores and the shop would comply with all the relevant policies such as “Challenge 25”.  The CCTV would cover all areas of the shop and it would not be permissible for patrons to consume alcohol on the premises.

 

The Hearing heard from the objectors who raised concerns about anti-social behaviour, road safety, parking, noise and underage sale of alcohol.  Representatives from the Parish Council expressed concern about late night activity in a residential area as the sale of alcohol would be likely to attract people to the area late at night.

 

At 11.10 hours the Hearing Members withdrew to consider the issues raised, with the Council’s Legal Advisor and Democratic Services Manager in attendance.

 

At 11.39 hours the Hearing Members, Council’s Legal Advisor and Democratic Services Manager returned to the Council Chamber.

 

The Chairman informed the Hearing that the Sub-Committee had had given due consideration to the representations made by the Applicant and interested parties and the Licensing Act 2003, Secretary of State's Amended Guidance issued under Section 182 of the Act and the Council's Statement of Licensing Policy under the Licensing Act 2003. One of the Conditions Consistent with the Operating Schedule was to be amended to require a CCTV system to be installed and maintained at the premises as well as covering the alleyway and access to the rear entrance in accordance with the recommendations of the Kent Police in line with Home Office guidelines.  The Sub Committee was satisfied that granting the application subject to these amended conditions would be in accordance with the relevant licensing objectives.

 

It was therefore,

 

Resolved: That a Premises Licence in respect of Mr Kanesanathan Kandasamay for West Kingsdown Mini-Market, 1 Portobello Parade, Fawkham Road, West Kingsdown, Kent. TN15 6JP, subject to mandatory conditions, and amendments to licensable activities, operating schedule and additional conditions contained in the notice of determination attached as an appendix to these minutes, be granted.
