Review of Hackney Carriage Driver's Licence

The Hearing gave consideration to a report by the Chief Officer Environmental & Operational Services giving details of complaints made by other Hackney carriage drivers and one member of the public regarding the Licensee’s behaviour.  There had been 12 complaints from other Hackney carriage drivers made between March 2014 and November 2014.  In brief, the complaints alleged that the Licensee had:

 

Overcharged a customer

Displayed Sexist behaviour

Had been abusive

Had harassed others

Had taken controlled drugs

Had been verbally abusive

Had made threats of physical violence

Had made death threats

Refused to take passengers using a wheelchair

 

The complaints were attached to Appendix A of the report.  The Licensee had himself made complaints against some of the hackney carriage drivers and the log of complaints was attached at Appendix B of the report. The report requested that the Sub-Committee consider the evidence presented, make findings on the evidence and consider if the Licensee was a fit and proper person to hold a Hackney carriage driver’s license.

 

The Hearing heard from the complainantsand asked questions.

 

The Hearing heard evidence from the Licensee, the Licensee’s Solicitor and his additional witness and asked questions. The Sub-Committee considered the evidence and exhibits tabled by the Licensee.

 

At the invitation of the Chairman, the Licensing Partnership Manager addressed the Sub-Committee and the Sub-Committee asked questions.

 

Following a request for clarification from the Sub-Committee, and with the permission of the parties, Mr Ron Parker, manager of Streamline Taxis, was contacted on a point of clarification.

 

At 12:55 p.m. the Hearing Members withdrew to consider the issues raised accompanied by the Council’s Legal Advisor and the Clerk to the Hearing for the purpose of providing advice only.

 

At 1:45 pm. the Hearing Members, Council’s Legal Advisor and the Clerk to the Hearing returned to the Council Chamber.

 

The Chairman advised the Hearing that the Sub-Committee had had regard to the evidence provided by the Complainants and the Licensee.

The Sub-Committee considered the complaint in the representation of Kayleigh Archer that the Licensee had overcharged a customer and been abusive. This complaint was not found to have been proven.

 

The Sub-Committee considered the complaint that the Licensee had displayed sexist behaviour, in the representation of Emma Barritt. The Sub-Committee found that the complaint was proven having found the complainant very credible and noting that the incident had also been witnessed by Stephen Batchelor.

 

The Sub-Committee considered the complaints that the licensee had been abusive, verbally abusive and made threats to others. The Committee considered these complaints proven, relying particularly on the representations of Emma Barritt and Bartosz Wlodarczyk whom they found credible. They considered that others had felt threatened by the Licensee’s behaviour.

 

The Sub-Committee considered the complaints that the Licensee had harassed others. These complaints were not found to have been proven.

 

The Sub-Committee considered the complaint in the representation of Bartosz Wlodarczyk that the licensee had taken controlled drugs. This was not found to have been proven.
